2025 Exams and the DMCC Act 2025

The Qualifications Panel (QP) recognise that students within the Qualifications Framework will be concerned about the Digital Markets, Competition and Consumers Act 2024 (DMCC) and the May 2025 cycle.

The QP have met to consider this new Act and have issued the following statement:
We acknowledge that this may come into force in April 2025 and have considered how this may impact students' answers. It has considered that under the Act, and as described in the syllabi, answers may be expected where legislation is enacted but not yet in force.
- For the May 2025 exam cycle, students can choose to answer either from the Consumer Protection from Unfair Trading Regulations (CPRs) or from the new Digital Markets, Competition and Consumers Act (DMCC).
Examiners have been notified of this allowance when setting papers for the May 2025 exam cycle. - When sitting exams in the May 2025 cycle, students are requested to write on the front of their paper, which legislation they will be answering from, to advise the examiner in advance prior to them commencing marking of your paper.
IMPORTANT: No student will be disadvantaged by answering from either piece of legislation.
The QP have also stated that no questions will include, for example:
- What are the differences between CPRs and DMCC Act? or,
- Where the question requires an answer that is only relevant to the DMCC Act, such as the new powers coming to the Competition and Markets Authority.
After the May 2025 exam cycle, it is expected that students will answer any questions relating to the DMCC Act, if it has been brought into force.
Students should consider undertaking specific training on the DMCC to ensure, moving forward, they are fully aware of the requirements under this Act.
